隨著城市現(xiàn)代化進(jìn)程的加快,居民的生活條件越來越好,電梯作為一種大眾性的垂直運輸工具,和汽車作為出行交通工具一樣,不可缺少。作為一種自動化的機(jī)電設(shè)備,使用過程中發(fā)生故障客觀上不可避免。如何通過規(guī)范管理、正確使用來降低它的故障率,使它更好地為我們服務(wù),是大眾關(guān)心的熱點問題。為普及電梯安全知識,提升公眾對電梯使用安全和管理工作的認(rèn)知水平,貴州電梯看到質(zhì)監(jiān)局特檢院編寫了“電梯安全十問十答”,供公眾閱覽。

How to reduce its failure rate through standardized management and correct use, so that it can serve us better, is a hot issue of public concern. As the popularity of elevator safety knowledge, enhance public awareness level of elevator safety and management work of the special inspection institute, Guiyang Quality Supervision Bureau prepared a "elevator elevator safety in a ten", for public reading.

一、電梯使用安全管理的責(zé)任主體是誰?

答:根據(jù)《中華人民共和國特種設(shè)備安全法》第十三條之規(guī)定,電梯使用單位及其主要負(fù)責(zé)人對其使用的電梯安全負(fù)責(zé),是電梯使用安全管理的責(zé)任主體。

二、電梯使用單位如何確定?

答:按照《貴陽電梯電梯安全管理辦法》和《貴陽電梯人民政府辦公廳關(guān)于進(jìn)一步加強(qiáng)電梯使用安全工作的意見》(閩政辦〔2015〕100號)規(guī)定,電梯安裝后,建設(shè)單位尚未移交給電梯產(chǎn)權(quán)所有者的,該建設(shè)單位為電梯使用單位;委托物業(yè)服務(wù)企業(yè)或者其他管理人管理的電梯,受托人為電梯使用單位;未委托物業(yè)服務(wù)企業(yè)或者其他管理人管理的電梯,屬于單一產(chǎn)權(quán)所有者的,該產(chǎn)權(quán)所有者為電梯使用單位;屬于多個產(chǎn)權(quán)所有者的,應(yīng)當(dāng)協(xié)商明確其中一個產(chǎn)權(quán)所有者為電梯安全使用管理人,其他產(chǎn)權(quán)所有者承擔(dān)連帶責(zé)任;出租配有電梯的場所,租賃合同中應(yīng)當(dāng)約定電梯使用單位,未約定的,電梯產(chǎn)權(quán)所有者為電梯使用單位;政府出資建設(shè)的公共租賃住房內(nèi)所安裝使用的電梯,房屋產(chǎn)權(quán)人應(yīng)負(fù)責(zé)落實電梯使用單位;多個產(chǎn)權(quán)所有者無法確定使用單位的,由所在鄉(xiāng)(鎮(zhèn))人民政府、街道辦事處協(xié)調(diào)確定電梯使用單位,經(jīng)協(xié)調(diào)仍無法確定使用單位的,由鄉(xiāng)(鎮(zhèn))人民政府、街道辦事處代行或指定電梯使用單位,并告知電梯產(chǎn)權(quán)所有者,產(chǎn)權(quán)所有者承擔(dān)連帶責(zé)任。

三、電梯使用單位的主要管理職責(zé)有哪些?

答:(一)在電梯投入使用前或者投入使用后30日內(nèi)向特種設(shè)備安全監(jiān)督管理部門辦理電梯使用登記,使用單位變更的,應(yīng)當(dāng)自變更之日起30日內(nèi)辦理變更登記。

(四)應(yīng)當(dāng)在電梯使用標(biāo)志所標(biāo)注的下次檢驗日期屆滿前1個月,向特種設(shè)備檢驗檢測機(jī)構(gòu)提出定期檢驗申請,繳納電梯檢驗檢測費用,并配合做好檢驗檢測相關(guān)工作。

(九)電梯發(fā)生事故時,按照應(yīng)急救援預(yù)案組織應(yīng)急救援、排險和搶救,保護(hù)事故現(xiàn)場,并且立即報告事故所在地的特種設(shè)備安全監(jiān)督管理部門和其他有關(guān)部門。
